1.         Mayor Scaffidi called the meeting to order at 7:00 p.m.  On roll call, the following alderpersons were present:  Ald. Jakubczyk, Ald. Bukiewicz, Ald. Ruetz, Ald. Toman, Ald. Gehl, and Ald. Michalski.  Also present were:  City Attorney Lawrence Haskin, City Administrator Gerald Peterson, City Engineer/Acting Building Commissioner Michael Simmons, Fire Chief Thomas Rosandich, Finance Director Mark Wyss, Community Development Director Douglas Seymour, City Librarian Jill Lininger, and City Clerk Catherine Roeske.

2.         The meeting began with the Pledge of Allegiance being said by all present.

3.          Ald. Michalski, seconded by Ald. Bukiewicz, moved to approve the minutes of the 4/17/12 meeting as published.  On roll call, the vote was as follows:  Ald. Jakubczyk, aye; Ald. Bukiewicz, aye;  Ald. Ruetz, aye; Ald. Toman, aye; Ald. Gehl, aye; and Ald. Michalski, aye.

4.        PRESENTED AND ADOPTED:  COUNCIL PROCLAMATION NO. 12-12 TO WALTER G. KOPPLIN, III, FOR DEDICATED SERVICE TO CITY AS MEMBER OF BOARD OF HEALTH.

Ald. Bukiewicz, seconded by Ald. Jakubczyk, moved to adopt Council Proclamation No. 12-12, to Walter G. Kopplin, III, for dedicated service to the City of Oak Creek as a member of the Board of Health.  On roll call, the vote was as follows:  Ald. Jakubczyk, aye; Ald. Bukiewicz, aye;  Ald. 5.        PUBLIC HEARING HELD TO CONSIDER A PROPOSED STREET VACATION OF SOUTH KNIGHTS PLACE RIGHT-OF-WAY.

A public hearing was held to consider a proposed street vacation of South Knights Place right-of-way (see Item 6 for action on this hearing).

6.        PRESENTED AND ADOPTED:  RESOLUTION NO. 11238-041712, VACATING AND DISCONTINUING PART OF PUBLIC STREET IN CITY.

Ald. Ruetz, seconded by Ald. Michalski, moved to adopt Resolution No. 11238-041712, vacating and discontinuing a part of a public street in the City of Oak Creek (South Knights Place).  On roll call, the vote was as follows:  Ald. Jakubczyk, aye; Ald. Bukiewicz, aye;  Ald. Ruetz, aye; Ald. Toman, aye; Ald. Gehl, aye; and Ald. Michalski, aye.

7.        PRESENTED AND ADOPTED:  RESOLUTION NO. 11259-060512, IDENTIFYING LOCATION OF CITY HALL AND LIBRARY AT DREXEL TOWN SQUARE (7929 S. HOWELL AVE.).

Ald. Bukiewicz, seconded by Ald. Jakubczyk, moved to adopt Resolution No. 11259-060512, identifying the location of City Hall and Library at Drexel Town Square (7929 S. 8.       COUNCIL AUTHORIZES CITY ATTORNEY AND CITY ADMINISTRATOR TO NEGOTIATE CONTRACT FOR OWNER’S REPRESENTATIVE SERVICES IN CONNECTION WITH CONSTRUCTION OF NEW CITY HALL, LIBRARY, AND FIRE STATION #1 WITH CHAMBERLAIN GROUP. 

Ald. Toman, seconded by Ald. Michalski moved to authorize the City Attorney and City Administrator to negotiate a contract for Owner’s Representative Services in connection with construction of a new City Hall, Library, and Fire Station #1 with the Chamberlain Group.  On roll call, the vote was as follows:  Ald. Jakubczyk, aye; Ald. Bukiewicz, aye;  Ald. Ruetz, aye; Ald. Toman, aye; Ald. Gehl, aye; and Ald. Michalski, aye.

COUNCIL AUTHORIZES STAFF TO SEEK PROPOSALS FOR ARCHITECTURAL AND ENGINEERING (A/E) SERVICES FOR BUILDING DESIGN AND ENGINEERING NEW CITY HALL, LIBRARY, AND FIRE STATION #1.

Ald. Toman, seconded by Ald. Gehl, moved to authorize staff to seek proposals for Architectural and Engineering (A/E) services for building design and engineering for  the new City Hall, Library and Fire Station #1.  On roll call, the vote was as follows:  Ald. 9.        COUNCIL FORWARDS COPY OF PUBLIC POLICY FORUM’S REPORT “EXPLORING SHARED OR CONSOLIDATED FIRE SERVICES IN SOUTHERN MILWAUKEE COUNTY” TO PERSONNEL COMMITTEE, FINANCE COMMITTEE AND POLICE AND FIRE COMMISSION TO REVIEW.

Ald. Michalski, seconded by Ald. Gehl, moved to forward a copy of the Public Police Forum’s report “Exploring Shared or Consolidated Fire Services in Southern Milwaukee County” to the Personnel Committee, Finance Committee, and Police and Fire Commission for review and to report back to the Council as it might request.  On roll call, the vote was as follows:  Ald. Jakubczyk, aye; Ald. Bukiewicz, aye;  Ald. Ruetz, aye; Ald. Toman, aye; Ald. Gehl, aye; and Ald. Michalski, aye.

COUNCIL INVITES ROB HENKEN, PRESIDENT OF PUBLIC POLICY FORUM TO  FUTURE MEETING TO PROVIDE PRESENTATION AND ALLOW PUBLIC INPUT ON OPPORTUNITIES AND ISSUES RAISED FOR SHARED OR CONSOLIDATED SERVICES CONTAINED IN PUBLIC POLICY FORUM’S REPORT “EXPLORING SHARED OR CONSOLIDATED FIRE SERVICES IN SOUTHERN MILWAUKEE COUNTY”.

Ald. Toman, seconded by Ald. Michalski, moved to invite Rob Henken, President of Public Policy Forum to a future Council meeting to provide a presentation and allow public input on opportunities and issues raised for shared or consolidated services contained in Public Policy Forum’s report “Exploring Shared or Consolidated Fire Services in Southern Milwaukee County”.  On roll call, the vote was as follows:  Ald. 10.      DIRECTED HELD UNTIL 7/17/12 COUNCIL MEETING:  ACTION BY COUNCIL TO WITHDRAW ITS SUPPORT FOR AMENDMENT TO PROJECT PLAN FOR TAX INCREMENT FINANCING DISTRICT NUMBER 10 (“TID 10”) THAT WOULD PROVIDE $4,500,000 IN DEVELOPER ASSISTANCE TO SYNER G LLC FOR 107 ROOM, FOUR POINTS SHERATON HOTEL AND APPROXIMATELY 1,830 SPACE COVERED PARKING LOT TO SUPPORT TRAVELERS TO AND FROM AIRPORT.

Gehl moved hold action by the Council to withdraw its support for an amendment to the Project Plan for Tax Increment Financing District Number 10 (“TID 10”) that would provide $4,500,000 in developer assistance to Syner G LLC for a 107 room, Four Points Sheraton hotel and approximately 1,830 space covered parking lot to support travelers to and from the airport until the July 17, 2012, Common Council meeting and to direct staff to meet with Greg Trapani to determine if he can fulfill the requirements for this transaction.  On roll call, the vote was as follows:  Ald. Jakubczyk, aye; Ald. Bukiewicz, aye;  Ald. Ruetz, aye; Ald. Toman, aye; Ald. Gehl, aye; and Ald. Michalski, no.

11.      PRESENTED AND ADOPTED:  ORDINANCE NO. 2654, REPEALING AND RECREATING SECTION 2.05 OF THE MUNICIPAL CODE TO CHANGE TWO POLLING PLACE LOCATIONS FOR THE CITY.

Ald. Toman, seconded by Ald. Michalski, moved to adopt Ordinance No. 2654, repealing and recreating Section 2.05 of the Municipal Code to change two polling place locations for the City of Oak Creek.  On roll call, the vote was as follows:  Ald. Jakubczyk, aye; Ald. Bukiewicz, aye;  Ald. Ruetz, aye; Ald. Toman, aye; Ald. Gehl, aye; and Ald. Michalski, aye.

12.      COUNCIL CONCURS WITH MAYOR’S APPOINTMENT OF FRED SIEPERT, 405 E. VALBETH, TO PLAN COMMISSION, FOR 3-YEAR TERM, EXPIRING 4/2015.

Ald. Jakubczyk, seconded by Ald. Ruetz, moved to concur with the Mayor’s appointment of Fred Siepert, 405 E. Valbeth, to the Plan Commission, for a 3-year term, expiring 4/2015.  On roll call, the vote was as follows:  Ald. Jakubczyk, aye; Ald. Bukiewicz, aye;  Ald. Ruetz, aye; Ald. Toman, aye; Ald. 13.      COUNCIL APPROVES VENDOR SUMMARY REPORT.

Michalski, moved to award the 2012 Sidewalk Improvements contract to the lowest responsive, responsible bidder, Q3 Contracting, at an estimated cost of $126,758.75 (Project No. 11019).  On roll call, the vote was as follows:  Ald. 21.      CLOSED SESSION HELD.

Ald. Toman, seconded by Ald. Gehl, moved to convene in Closed Session at 8:12 p.m., pursuant to Wisconsin State Statutes to discuss the following:

  1. Section 19.85 (1) (e) and (g) to discuss possible litigation involving Colonial Woods Limited Partnership regarding a deed restriction on property at 8245 S. 20th Street;
  2. Section 19.85 (1) (e) to discuss a proposed Exchange Agreement with Milwaukee County regarding properties at 8245 S. 20th Street, 2211 W. Drexel  Avenue, 2301 W. Drexel Avenue and 2200 W. Drexel Avenue; and
  3. Section 19.85 (1) (e) to discuss a proposed Memorandum of Understanding with Fifth Property LLC regarding property at 4301 E. Depot Road (the former Hynite property).

23.      PRESENTED AND ADOPTED:  RESOLUTION NO. 11260-060512, APPROVING EXCHANGE AGREEMENT BY AND BETWEEN CITY AND MILWAUKEE COUNTY.

Bukiewicz, moved to adopt Resolution No. 11260-060512, approving an exchange agreement by and between the City and Milwaukee County with adjustments to be made by the City Attorney.  On roll call, the vote was as follows:  Ald.
